Stop and Fight Your Ticket
The California roll is a popular term, it is also a violation of California stop sign laws. Getting a ticket for failing to stop at a stop sign can result in a point on your driving record and a hike in your insurance rates.
Know Your Rights
The traffic court judge has the ability to use his or her own discretion when reviewing certain circumstances that may have been beyond your ability to control. For example, if we are able to prove that your conduct was the result of an error that was honest and reasonable, the court might find that you made a “mistake of fact,” your ticket could be dismissed.
Some examples of these stop sign defenses include:
- You did not see the crosswalk markers because they were not clearly visible
- The stop sign was not hidden because a tree is blocking it
If this is the case, we can introduce the proper evidence to prove your defense and get your stop sign ticket dismissed. Often this argument comes down to your claim that you weren’t given fair notice as to the conduct that was expected of you. For example, a judge might dismiss a ticket for running a stop sign if it was brand new. However, the judge would probably not buy this defense if:
- the stop sign had been there for a couple weeks or more
- you were speeding
